We interviewed Bruce Nestor of the National Lawyer's Guild when we were at th 17th Street Raid. He lives in the neighborhood and is representing one of the people who was arrested there. I'm including part of the transcript of the video because I think he contextualizes well what is happening:
Glenn Greenwald: So what were they charged with?
Bruce Nestor: They were charged with conspiracy to commit riot, which is about as bullshit a charge -- about as thin a charge -- as you could possibly come up with. And I say that as a lawyer.
Glenn Greenwald: How do you distinguish between that and a protest?
Bruce: You can't. It basically criminalizes political advocacy. I mean, the essence of conspiracy law is if a single individual takes an overt act towards accomplishing an illegal goal such as purchasing a brick, and the police then claim that someone else in his group has an intent to throw that brick, then everyone who advocates that you attend that demonstration...
Glenn: Even if you're not intending to commit that crime...
Bruce: ...even though you're not intending to commit the crime, could all be charged with conspiracy.
Glenn: Is that a very rarely used statute in Minnesota?
Bruce: In Minnesota it is hardly ever is used in state court. Conspiracy is a popular charge of federal prosecutors, because it expands the realm of evidence.
Glenn: But this specific conspiracy...
Nestor: I've never seen it before.
Glen: And you're a lawyer in Minnesota.
Nestor: I'm a lawyer in Minnesota.
Glenn: And you've never this seen it until this convention.
Nestor: That's right. I will say that in 1968 the Chicago 8 were charged with conspiracy to riot. Roundly criticized, in the however many years since now, thirty forty years, as a politically motivated prosecution -- as the type of charge that really is criminalizing free speech activity, and putting people on trial..
Glenn: I mean it clearly seems like it's clearly intending to intimidate. You break into a house with 25 officers with submachine guns drawn and put them all on the floor and handcuff them, it's clearly sending a message that they might want to think twice about participating.
Nestor: I do think....We're not in this country yet where we're having mass detentions of people like this, so it really is about sending a message. I think what it really is designed to do is to send a message to people who agree with some of the viewpoints of people organizing activity and to say - you know what? You can write an email, it's okay to write a letter, to vote, but don't go out in the street, don't organize public activity, because do you want us bursting into your house? Do you want to be associated with people who are getting arrested? It's designed to somehow say these aren't citizens engaged in the exercise of political freedom, but that they're kooks, they're freaks, they're dangerous, stay away from them, don't get involved.
Glenn: And there's been no evidence that any actual violence or illegality has been committed, this is all preventative right, it's all anticipatory?
Bruce: That's right.
During the 2000 RNC, police also targeted protesters. And the Minnesota Independent has been reporting that the $50 million security budget for the Minneapolis RNC was redacted by the Department of Justice for "security reasons." This isn't about breaking up a legitimate threat, it's about intimidating people from engaging in their right of assembly.

If they are targeting “Food Not Bombs” what does this mean to all those that helped keep Cindy Sheehan’s protest going in Texas? Food Not Bombs was a major player in providing what was needed to survive down there, and I know people from all over donated to them.

I am flabbergasted, and I live in the Twin Cities. Ohmygod. As many of you know, one of my favorite concepts is that it’s time to take to the streets and storm the Bastille. A metaphor, okay, Big Brother? This is absolutely unacceptable, this police state thingie happening in my Twin Cities. Gonna poke around for a while amongst the locals and see what I can find out. More soon if possible.
The kids were so fresh-faced and nonviolent. The idea that they’re some kind of threat is absurd.
Glenn was talking to Bruce later on, and we saw that on the search warrant they were looking for things like cardboard, string, and urine. We supposed it was for a urine bomb. According to Bruce, they found five pails of urine in one of the places and were running around crowing that they’d discovered some bomb making effort.
Turns out there was just an illegal apartment on the premises with no bathroom.
I think the state legislature needs to investigate this operation.
The essence of BushCheney is disdain for the laws that protect citizens and bottomless retribution against their political opponents. The Minneapolis arrests, nominally state (not federal) acts, required collusion by Minnesota’s Republican governor and the considerable expenditure of the state’s cash, staff time and political goodwill.
Like the arrest of peaceful citizens for not goose-stepping into ”free speech” zones in order to keep Junior inside his bubble, believing everyone agrees with him, these arrests will be successfully challenged in court. But that will take months or years, and be lost in the post-election shuffle, allowing BushCheney to break yet more laws without retribution, the yardstick against which Mr. Cheney measures his manhood.
The Democrats set themselves up for some of this by their relatively minor wrongs in Denver. They should it a priority to publicize and attack these police-state tactics.

All the (increasing numbers of) videos up on youtube are astonishing. It is interesting that this is going on in Mpls/SP but apparently not Denver. At least if it was in Denver, we did not see this. And the convention is not even begun. Is there a difference between the conventions or is it the police that are more on edge in M/SP than Denver? Who is driving this?

And to think I almost let my friend talk me into going to the convention with him and a 30-foot inflatable rat. While I think my wife might get a kick out of seeing me tazed on national TV, I’d prefer to avoid jail.

Minnesota has a Republican governor who was on the short list for VP, obviously he’s not going to interfere when the Bush-Cheney feds want them to crack down. Colorado has a Democratic governor. They’ve politicized everything, and they would have loved for there to be outrageous or violent protests on TV in Denver. Why would they try to prevent them?
Jane, big props to you & Glenn for going there, filming it and posting about it. It’s unbelievable that no major media outlets are reporting on this.

this video at the uptake link shows a lawyer in handcuffs in front of the house full of reporters being detained, and the media crowd covering. someone who showed up to pick up a democracy now reporter for work gives a good rundown.

During the NYC Repub Convention in NYC you’d see the cops with their mulitple plastic handcuffs strapped to their belts. And the policy was AMBUSH clusters of protesters. Not the leaders at the heads of the lines or the main speaker. Just sudden “ambushes”. And they did collect many who were in “legitimate areas” for marching or collecting (with permits having been extended) which was sorted out AFTER jail time. Bloomberg stayed popular with most despite the fascistic methods. But this stuff here is bringing back that stuff MULTIPLIED in ferocity.
I most fervently hope that every single person arrested under these bullshit charges DEMANDS to have his or her case tried by jury.
Pretty ironic that the same folks who pray for the Rapture are likely to arrest Jesus if he shows up in St. Paul.

As Jane implied, the feds may have put a lot of federal ”aid” to Minnesota on the table, ostensibly for ”law enforcement” or ”national security” purposes, effectively underwriting these police state tactics. If so, I assume it would have been with the expectation that they be aggressively used to protect the Gooper convention — and, indirectly, to stifle dissent and, later, to keep citizens from going to the polls. I wonder what variation on conspiracy the Rovites will invent for mass arrests related to conspiring to vote?
